I'm also getting a bit annoyed with how the headband starts digging in to the top of my head after about 20 minutes. Has anyone tried putting a piece of foam or something up there to help with this problem?

If it's really a concern, buy a extra headband for Beyerdynamic headphones and wrap that around it. The Beyer headband is the most comfortable there is, and is a snap-on job, so can be put on almost any headphone.

Is the rattle when you move the phone around or when it's playing music?

No, there is no audible presence of rattling while playing. Only when you shake the phones while they are off your is head is the rattling sound noticeable. Do note that the sound is only resonating from the right cup, to me it sounds like when you drop your cell phone a few too many times. However these have not been dropped.
