Not if it's a standard essential patent I believe.
It would be impossible to argue that ABTX essential to bluetooth audio. It is only an improvement. Like Sony's new bluetooth format, or DTS is to Dolby.

I just received my Momentum Bluetooth a few days ago and like some others had connection problems with my MacBook Pro. The following link helped me out and even though it's directed to Yosemite users, the fixes are just basic OS X resets that would apply to other OS X versions. BTW, all other BT connections for iOS and other BT devices are stable and solid.

Even outside with your iPhone? I have my doubts.
I'm at a loss for how to respond to your comment.
That is only partly true. There are also other chipsets with aptX support, for example from Broadcom. In this case only the codec is licensed from CSR.
IOs devices doesn't support aptX because the power consumption is higher than AAC. And Apple knows what is the best for their customers...![]()
Now comes the trouble, I did pair with my Macbook Pro Retina first and I had an horrible experience trying to listen to any sound at all. It skips/stutter so much it becomes impossible to enjoy any audio. I never had this problem with the Plantronics. I also managed to figure that if I turn wifi antena off the audio gets a little better but still skips/stutters.
Unlike in ears or some noise cancellers like Bose or Parrot, the Sennheiser Momemtum W2 allow voices and sudden loud noise through, at a controlled lowered level. I guess it's safe to be walking around city streets with this or to snoop on fellow passengers but I would love to have total silence. Is there a mode for that with these cans?
There is no mention of a silence mode in the quick manual.

To elaborate: If you so far only had limited time with the cans outside, it might be that you simply didn't get into a situation yet where the Momentum Wireless couldn't deal with the interferences.
There have been too many reports of owners with said problems that it's difficult to believe that it is due to broken sets or something when using the same devices.
Maybe just for the heck of it I should tell Sennheiser to send me a replacement.
Update: So, I just arrived at my hometown and first thing I did was to pair the headphones with my windows desktop. It's working perfectly... That being said, Macbook Pro stuttering / skiping is most probably due to the Wireless and Bluetooth problem.
Resuming, until now I did test it inside walls (home) with:
1 - Macbook Pro Retina (Yosemite 10.10.3 Beta Preview), a lot of stuttering/skipping problems;
2 - iPhone 6, not a single problem;
3 - iPad Air, not a single problem;
4 - Windows 8.1 Desktop, not a single problem;
5 - Minix NEO X8-H Plus, not a single problem.
Tomorrow I'll try them outside.
This was the fix for me with my Mac's bluetooth audio:

Worth a try...
What have you done, SMC and PRAM reset?
My only problem until now is when connected to my Macbook Pro Retina with Yosemite. The connection stutters so much that I just can't use it via bluetooth.
You managed to solve the problem with Momentum Wireless?
Because I have no problems while using Plantronics Backbeat Pro.
