I'd honestly skip eBay altogether unless you find an authorized dealer, because you don't get any warranty if you don't purchase from an authorized dealer, and you lose the 'you break it, we replace it (once)' and the lifetime defect warranty that Monster gives you.
But, it's your decision. They don't look suspicious, but there's no concrete proof they aren't fake. You're probably safe given the seller's ratings, but take everything with a grain of salt.

If you won, you're fairly obligated to pay, so, I think you effectively bought them.

Well... I just bought a $400usd worth of ath-ck100's on ebay...(not an authorised dealer) - based in Hong Kong.
The guy selling your IEM's seemed pretty legit though - a great deal of positive feedback and only 1 negative. - Selling altered goods or leading consumers to believe that a good is what it's not is illegal - and if worst comes to worst im sure you can take it up with the man personally.
 
If I were you, i'd buy them :D

Looks like you got your hands full now. I cant believe eBay allows this to continue with all the knockoff complaints they receive. That's why i try to stay away from buying stuff there unless i have to. They only care about one thing getting there FEE'S

Those are absolutely fakes. I have a pair I bought from DealExtreme on a lark for $33. Had the Supertips sticker and all. How to know? The 'Monster' emblem on the magnetic closure is much closer to/covers the stitching on genuine cases, the machining of the 'turbine fins' is much more crude, and the 'copper' images on the box will look more grey/gold than copper as they do in those photos. Contact the seller and tell him if they aren't genuine you want a refund. If he refuses, file an Ebay/paypal complaint. 
 
As for how they sound? Lots of bass and highs, but grainy as hell and fatiguing.
