first off I lived not too far from there on Beach 123rd in the Rockaways and the lifeguards are great. While wearing headphones at work as a lifeguard is questionable you can't hear much on the beach anyway between the wind and the surf sounds do not carry very well, hence the whistle. Lifeguards depend most on vision and to me he is oriented on the water watching his area of beach.

The shameful action here is by the NY Post for exploiting the death of the Bronx man days earlier at the beach. THe last thing the relatives of the dead swimmer need is a jerk reporter making their pain and loss even worse.

Finally swimmers need to be responsible and understand the dangers of the ocean and their swimming abilities.

Yeah, after reading the article and some of the reaction, the whole thing was blown out of proportion and it was an all-around sleazy thing to do. He does have rain gear on so that implies that there was nobody even close to the beach at all.

While it may be blown out of proportion, a lifeguard should have his FULL attention on the beach and the bathers. There is no way to justify the use of headphones while working as a lifeguard.

If nothing else the guy should realize this doesn't look good and doesn't have the sense to wear something a little less conspicuous. He should be fired just for being stupid (and having poor taste in headphones).
