so i got the headphones today, is one side supposed to be louder

No. You can double check to see if one side is indeed louder by getting Foobar2k and getting a channel reversing plug-in. The idea is that when you think the headphones are imbalanced, you reverse the channels and physically reverse the headphones on your head. If they sound biased to the other side, you know you have a channel imbalance.

ends up that they are unbalanced(tested with two friends), so I am thinking about asking for a replacement, the only proalem is that they dont have it in stock, should i get a different pair of headphones?

Will breaking them in get rid of that?

It is doubtful that breaking them in would fix an issue with balance. Likely it is a faulty pair. It is a shame that you can't get a replacement.
