I don't think its 'fraudulent' its just marketing.
 
I got the Tpeos H-100 for $150 and now its sold here at $50 and its the latest edition with remote/mic etc. It's just good marketing.

I bought it from Amazon from a seller claiming that he is "authorized" VSONIC seller with 1 year warranty.

It was sealed by 2 VSONIC stickers on both sides and the whole package was sealed also.
 
There is another member in here that didn't get the foam tips and the other bag exactly like me.....
