I'm in the US and my pair was out of warranty by 4 months. Sony replaced it after reaching out to customer support and escalating my communications about the battery issue immediately on the first call.
There is no doubt Sony is at least implicitly taking responsibility for the battery failures. I know that Sony is replacing out of warranty units.

Clearly it is common belief that a firmware update caused this problem. I am asking if Sony has confirmed that a bad firmware caused this problem.

Sorry, just for clarity, was this confirmed by Sony, or is it confirmed in the sense everyone has concluded it is the theory that best fits observations? I am not challenging, just trying to understand. I understand Sony is replacing out of warranty pairs.
Starting at the end of July, there have been a large number of reports of severe uneven battery drain in the WF-1000XM4 earbuds. The common factor appears to be the 1.4.2 update. You mention this software version, and there are no issues whatsoever with a replacement, just steps taken to get ro that point.

I don't know a current modern company that would outright claim the issues on the particular firmware. The rule is always to just push the next update, and hope you the least number of calls for replacement. If you admit blame, you guarantee far more replacements than simply pushing new update and hoping enough people are satisfied. That's called a cost effective business decision

Short answer is no.

Some believe the Zenipower battery is at fault affecting an isolated batch of the model. Two of my other friends have zero issues with their unit bought at the same time - yet mine crapped out.

Pretty disappointed by Sony. Had my unit for over a year without any issues, until about two weeks ago when the left battery started draining completely in about 30 minutes. Went through Sony support process and they were ready to replace the unit. Then they looked up the SN and said my unit was refurbished and they wouldn't replace it unfortunately. They gave me the contact info for their service vendor that i'm supposed to get repaired myself I suppose? Now debating getting something else or wait for xm5.

FYI, been going back and forth with Sony on my replacements. They first offered silver which I declined as I am not a fan of the color. Then offered new buds/used case in black or wait until Septemberish time frame. I told them I would wait until new comes in as I have other TWS to use.

picked up these leashes and so far they seem to stay in my ears slightly better.

I cut the goofy leash off, wondering if maybe the right rubber band would do the same thing?

I have never been able to get them to stay in well. some of it probably has to do with my oval shaped ear canals that are nearly impossible to make a seal. I use CIEMs mostly.

still looking for the perfect large 14mm tip. will be interesting to see how the XM5 fits.

Target has XM4’s for $118 refurbished, but the battery issue has me hesitating
I bought a refurbished pair 7 months ago, no battery problem. $118 is a good price.

Can anyone recommend me a set of tips for these please. Something silicone. I use the medium stock tips and they fit fine.
