HD SOLO Channel Imbalance Issue

Received my HD SOLO a few days ago. At first impression I immediately noticed there is a channel imbalance between the two speakers.
 
The right side is more muffled and vocal more recessed.
 
Basically it feels like the left side is louder and more clear than the right side.
 
I've burned it in for about 50 plus hours by now and has not improved.
 
I did notice that if i turn the volume up and turn on the the BBE EQ it seems to get better a bit.
 
I also notice that at the same volume setting my Beats Pro is louder than the SOLO HD
 
Does that mean the I9 isn't driving the SOLO HD correctly? Or I received a defective pair?

Try it with another pair of headphones, even a cheap one, and if you can set the channels to mono. That way you can tell if its the I9 or the Solos, although I'd imagine the latter.
