Sennheiser CX500 - Real/Fake/USED? - Bought on AMAZON

This isn't the first time I've ran into problems with Amazon & Sennheisers...
 
I made an unboxing video here:
 

 
 
However, after unboxing I realised 3 things:
1. Extra small tip
2. Extra "rubber" cable management system
3. Dirt on the earbud itself
 
So my question is simple:
1. Are they fake?
2. If not, as they sound good out the box, are they used, or have been re-packaged?

UPDATE:
 
Went for a refund....last time I'm buying senns.
 
Here is what the seller had to say of it:
1.

I can confirm that all of our headphones are genuine, we have asked

So how do you do spot checks on closed packaged items that are sealed?

Them again:
They are simply resealed using the heat injector machine, exactly how they are put into the packaging.

So they can be re-sealed?
What says that they haven't been replaced....
This is the last time I'm buying sennheisers - going to get a refund and buy some denon's.
