Sampling Rate

Some months ago I downloaded Hollywood Undead - Swan songs album encoded in mp3 (yes it was an illegal download, since I can't afford to buy many albums I have to "try" them first, and then if I like them I usually buy the original cd for FLAC quality)

Today I bought the cd and ripped it with EAC, but before deleting the mp3 I noticed that the FLAC ones had the standard CD quality sampling rate (44100 Hz) but the downloaded mp3 had a higher sampling rate (48000 Hz).

Since CD sampling rate is 44100, what could be the source of the mp3?

Easiest explanation is that someone changed the sampling rate either during or after the encode. Some people believe that upsampling MP3's makes them sound better. Still doesn't make it true 48k sampling.
