When i take the 701's off the left side of the headband slides down to the lowest it can go, like i would assume that it should. but on the right side it tends to stay up and I have to manually push it down. its not really a problem but is this normal? I don't want to return it either because 100 hours of burn in is a reeaaallly long time and i'm only a 3rd of the way there.

I don't know because mine came used and had twistie ties holding them in place all the time.

It probably means the elastic is a bit stretched. You can open up the bottom clip and make the elastic tighter.

I have the same "problem," except that the left side stays up.
Edit: By the way, my is about 4 weeks old.

Same thing here. but here's an insight. When you slip the phones on, the tension bars vary according to the angle of the cups and the speed with with which you put the phones on. Try playing around with the earpads. Of course, as mentioned above, you can always use the rubber band solution if the tension bothers you
