Irregular Apple iPod volume levels

I have noticed a strange volume behavior with my North American spec. fourth generation Apple iPod 20GB when adjusting volume levels. As the graphic display volume indicator is increased to approximately 85-90 percent, the volume only minimally increases and or seems to remain at approximately 40-60 percent volume range. When the graphic display volume indictor is set to 50 percent or below there is slight to no detectible volume. I have found that if I switch off the iPod (or soft rest) the volume/iPod return to normal function. Has anyone seen this behavior?


Notes about issue:

iPod is in excellent mechanical condition and never dropped. This issue appears to not be headphone/earphone dependent.

Have you tried hard-resetting the player?
Have you tried updating the software to the latest version 2005-03-23?

Occasionally the volume control "freezes" on my Photo 60GB - toggling the hold button on and off unfreezes it.

Yes the software is updated, no restore or reset type seems to permanently correct the issue. I suppose a call is due to Apple Care.
