Help: Are these Shure SE215s fake?

Hi,
 
I was wondering if anyone could let me know if these Shure SE215s are fakes? I bought them from a UK seller on eBay and he is selling them BIN for £55.

Also, when I removed them from the packaging one of the casings split, and has a bit of a rough feel to the edge. Here's some pictures of the insides:

I decided to give them a listen, they seem to be muddy sounding without much clarity and lacking in the mids with quite sharp highs. This all seems to point to them being fake and I did a search on this topic and didn't find anything conclusive.

If you look at the FR graph from innerfidelity, I would expect them to sound muddy, lacking in mids with piercing highs.   That's why I passed on them.
