If you downloaded the *.flac files, someone might have taken something like 128kbps *.mp3 and converted that to *.flac. Which gives you the same quality as the 128kbps *.mp3 in a bigger file size.

Possible? Sure. Just use a low-pass filter at 16 kHz.

The Fraunhaufer AAC encoder uses a 14 kHz low-pass filter by default, same as what terrestrial FM radio stations typically use. The filter eliminates high frequency compression artifacts. I figure your recording was taken from a source using a 16 kHz low-pass filter for the same reason.

Honestly, no. I try the album first, and, I buy it If I like it. The rip is not mine...

Then most likely it's like what  higbvuyb said. It's not a true FLAC but a lossy to lossless conversion(which sort of beats the point)

I think the other rip was a holy transcode...

Transcoding itself won't alter the frequency range. Like I wrote before, that's done with a low-pass filter.

Interesting. So interesting considering that any album in CD rip lossless are 20-22 khz. And, a 128 kbps mp3 converted to FLAC is limited to 16 khz. like the mp3.

This assumption is incorrect. MP3 is not limited to 16 kHz.
