What bitrate are your files encoded at? Apple says 8 hours for 128kbps, so if you encode at higher than that, the battery life will go down. I did a battery test and got 7:20 playing ~256kbps. If you do indeed have short battery life not due to encoding rate, then exchange it for another one.
