Beware of In Ear Systems, Inc (Fidelity Custom Earphones)

DO NOT ORDER ANYTHING FROM IN-EAR-SYSTEMS INC, ALSO KNOWN AS FIDELITY MONITORS.
 
I ordered, paid and shipped my impressions to In-Ear-Systems inc in June 2011. As of today, 11-11-11 I still have not received my IEM. They rarely answer phone calls, I only reached them 4 times. Each time I spoke with them they gave me a different story as to why I haven't received my IEM.They do not return voicemail messages or emails. The only 2 emails I received was my confirmation that they received my impressions and my receipt for my payment in full. Better Business Bureau of Nashville has 40 complaints against them for late or nondelivery of products all dated since this past summer. I filed a BBB complaint and In-Ear-Systems did not reply.

YIKES!!!!  Not what I wanted to find when I searched for this. I ordered some triples 10 weeks ago and cannot get a response from Fidelity. How did you get a charge back on your card? I guess it's worth a shot even if I lose my impressions I sent them.

I'm too a victim of their non-delivery.
I ordered mine at the end of July, they cashed my check in Aug 1st, but till now, I have not yet received my IEM.
BTW, I am in Asia, so it is expensive for me to call them every day.
I never got through on the phone, although I did tried to call them everyday for a whole week, but I've only get 2 E-Mails after the incident.
First they say there is problem with their lab, then the owner said she had personal issues that's effecting work.
They are full of crap!!
They won't give me refund, and they won't deliver.
 
I checked their business listing, they are still around, but they have not yet resolved their problem yet.
 
I am surprised that there are people who waited over 6 months and still haven't gotten anything yet.
 
Their complains has gone up from 40 to 60 to now 70 complains. 
 
Anyone every consider going through legal?
 
I am glad someone is passing the news around, so people won't fall into their trap any more.

BBB has 80 complaints posted. They are not getting a reply from Fidelity on any of them. An attorney representing 2 of us at our church sent them a letter on 11/15/11 advising of legal action, but he hasn't received a reply either

I would gladly join that lawsuit or provide testimony if need be. My story is exactly like those above. Except my order was placed in early Oct 2011. I did a chargeback thru my bank and I'm good on money but they still have my molds. 
 
I left voicemails at the office and home #, found them on Facebook and messaged both of them there and finally sent a fax to formally cancel the order.

I ordered mine back in June. They got my molds and money on June 20th. After months of getting the run around, they are finally being delivered tomorrow. I actually know people that ordered theirs after mine that already have theirs. I don't know why a company has to be like this. If you can't deliver, just be up front and say it. It's much better to be one step ahead of the customer than 100 steps behind and trying to dig yourself out of excuses. I sure hope that they are all that I hoped they would be or I'm gonna be pretty upset. I'll give you an update when I get them and let you know how they sound.

This is what I have done.
I am actually in Taiwan, but I could care less about the international calls charges any more.
I tried to call them every day and write to them every day, until one day they agree to give me refund.
BUT, that was just another lie.
They have gone silent again.
Here is a facebook page I have created, I hope all the every can join and have a more organized discussion.
Even if we don't get our money back, I think it is right to pass the message alone so no one will get fraud again.

And yet, I have forwarded the link to Fidelity, so they will be aware of that we are organizing against them, so we may have a better chance of getting our refund.

I spoke with my credit card company today. They can not do a charge back since the transaction was over 60 days ago. So, hopefully if anybody sees this thread within 60 days of paying them, they can do a charge back. Now, we'll have to see if an attorney can help. I get the feeling that we are all going to get screwed though. Best of luck to you all.

That is standard policy. However, I have been able to have them initiate a chargeback with an order that was 5 months old. If you can get any confirmation about your product still being "worked on" preferably via e-mail, and that is fairly recent, you may still have a case.

Well I finally got my Fidelity Duals last week. After six months of waiting, they are finally here. I can honestly say that they are very nice. I posted a little review of them on my Facebook page. I was able to talk to Kat (the owner) for a while a couple of weeks ago. I told her that I was afraid that I was never going to get my in ears or my money. I told her that I needed one or the other and I had felt like there was a lack of communication and that many people were feeling the same way. She said that she is running everything herself and doesn't always get a chance to respond to everyone. I didn't say much, but let's be honest, she doesn't respond to anything. This has been a horrible experience, but all I can say is I'm glad it's over. I have them. I like them. Thank the lord i didn't throw away over $300.
