An update to the above issue - the problem comes from inconsistent power from my laptop docking station USB. If I plug the MIC charger into a wall outlet usb adapter, it powers the MIC and solves the slider issue. Been drama free since I've made room to plug it in. Great solution.

This is what I understood. Which leads me back to the question of why is it on the market in its current state? Who buys these things in enough volume so fostex doesn't say "****, we kinda screwed this one, let's make a couple changes to fix it." The reviews out there for them aren't great at all.
