Paypal dispute

I have a question. How long do you guys usually wait before opening a dispute with the seller in Paypal? I purchased the item about 3 and half weeks ago and haven't received it yet. I've emailed him multiple times and usually get a very brief, unhelpful one sentence reply. He first said they was sick, and I said that's fine by me as long as he can ship it out once able to. It has been around 2.5 weeks since then, and he said he was going to ship it out the friday before last. If that were the case I would have gotten a long time ago though. He hasn't responded to my last two emails

The thing is, his feedback is almost perfect. I don't know if this person is just really lazy or just isn't going to ship out my package. Luckily, this is only my first truly negative experience on ebay

How long would you wait before opening a dispute with paypal? I'm getting tired of all of this and don't want to wait any longer. Any suggestions?

Just before the window where you can file a dispute closes (40 days?). At least then you can say you were patient..

BTW I haven't had to file a dispute, but if I did it would be like that I supposed.

I would file a dispute now. If you email him to let him know before you file, then that gives him time to pull his money out so I wouldn't notify him until after you have filed the dispute. I don't know if he can give you a negative feedback with the recent Ebay rule changes. If he can, then you need to decide which is more important...your Ebay feedback or what you bought. This is why I don't shop on Ebay anymore. I hope it works out for you.

Hmm.. I've already forgotten about the new rules. I don't think they went into effect yet, because I left a feedback as a seller just yesterday I believe. Actually, that would help a lot, since I know this seller will probably leave retaliatory feedback despite the fact that I did nothing wrong.

I do want this item rather badly, but I just think that if it hasn't come by now I'm not getting it, especially since the seller lives not even 200 miles away from me.

There could also be the possibility that the shipping company lost the item. Even still, that's more off the responsibility of the seller who should have a tracking number and can actually do something about it.

I think I will wait another day

File it now. Don't worry about hurting his feelings. If he makes good, you can drop the dispute and nothing will happen to him. You've got nothing to lose by filing.

Don't wait any longer. 3 1/2 weeks should be more than enough to ship the item to you, or at least respond back to you.

Thanks for the help guys

I filed the dispute and the seller escalated it to a claim, providing a tracking number that is not identified by USPS (although it is legitimate). Kind of fishy if you ask me

Not sure what to do now, if I can do anything. Hopefully I at least get my money back in return. I just wish the seller wasn't such an ass and responded to my emails as quickly as he responded to the dispute.

EDIT: Just checked my paypal account and the seller claimed he was sick (flu) all this time and had to no choice but to wait. I will see if the USPS number turns out to be legit tomorrow. I have faith in people so I assume he is telling the truth. Still, responding to an email every once in a while while your sick is not the end of the world I think. This was a $300 item

Sorry, one last quick question guys

If I close the claim, will I be able to reopen it later on if I still never get the item? For all I know the tracking number could be for another item and not even headed to my address

Paypal says they will investigate it within 2 days, and I'm afraid I will get the item after 2 days and not be able to stop the investigation. Obviously not what I want

DON'T CLOSE THE CLAIM UNTIL YOU HAVE THE ITEM OR THE REFUND IN HAND! Sorry for the yelling, but once you close the claim, that's it.

Well, new and interesting update guys

I get a package today... finally... and I'm 100% certain there is nothing inside. Furthermore, the item is addressed to me from "ebay" and not the seller.

Unbelievable. I'm so happy that I didn't cancel the claim, but now I have no leverage since he provided a tracking number

What should I do next? This is just ridiculous, and not what I need to be dealing with right now. I can't believe some people can be so ****ing amoral, first with the lying and now this

By the way, this is supposed to be a CD3000. Unless the headphones weigh less than a feather there is nothing in the box
