OK, let's have some fun with this: What does this statement mean?

I'd like your opinion about this statement from an employee handbook:

"Company X, provides salary continuation protection for its regular full-time
employees against loss of income sustained due to an illness of eight or more days or an accident upon the first day."

Now, does that mean that you get benefits from the first day of an accident, or does it mean you get benefits from the first day of an accident or illness?

I think it was worded badly, what do you think?

The second choice should have read "Benifits from an accident or an illness"

It means, get a lawyer because you will fall upon deaf ears and violins playing in the background.

The accident part is obvious.

The illness part reads to me that you get nothing for an illness that lasts 7 days or less, but since they say "loss of income due to illness of eight or more days", it reads literally like at that point they should cover all lost income .... including that from the first 7 days. That's not likely what they mean of course as it would encourage anyone off sick to extend their absence to 8 days in order to collect for the first 7. Who would go back to work on the 7th day and collect nothing, when simply by taking one more day off they'd collect for the entire 8 days?

You're right, it is badly worded. I'm assuming you're hoping to collect for a "less than 8 day" absence and they're saying you only get paid starting on the 8th day? If that's the case, you'd probably win in court. Of course you wouldn't be overly popular with your employer at that point however.

I agree with mbriant. Both in his conclusion of what it says, and that it's very badly worded.

I also agree with dbfreak. Get a lawyer. Often things are badly worded to allow the writer necessary wiggle room so they can do whatever they want. I hope you're asking out of curiosity and not because you need to use this particular "benefit".

Unfortunately a lawyer would cost more than I would gain.

I was out due to surgery from 8/28 to 9/9 and then worked 2 half days last week. Been back to work full time this week.

Because of the way the HR guy (who probably wrote this) interprets it, I'm loosing 5 days pay. (Strangely enough, they count the weekends as missed days which doesn't make sense either since I'm not normally paid on the weekend unless I'm working OT)

I thought I'd get paid for the whole time as did my supervisor.

I claimed short term at another company several years ago and it they covered the entire time I was out.

Thought I'd see if others read it the way I did.

I am a lawyer and to me this reads OR; the loss of income must be due to either (1) an illness of eight or more days OR, (2) an accident on the first day...

It's going to depend on a few interpretations of the law in the state you're in.

I would recommend speaking to a labor and employment attorney. Many of them give free consultations and work on a percentage of the recovery.

Recovery (probably, I'm not sure) wouldn't be enough to justify working on a percentage. However, the attorney might fire off a love letter or two for a lot less than you expect. If a letteror two gets you paid, it'll be worth it.

You should also ask the lawyer if your state's labor board (there should be one) has any kind of enforcement mechanism for unpaid wages that might apply to you. You might be able to file a form or two or three and get the state to force them to pay you.

Again, I have no idea how this works in your state, but I really think you should talk to a lawyer or two to find out what they think. It shouldn't cost you anything.

If you need a referral, call your state's bar association. Just Google your state's name and "bar association" and you'll find it. Most bars keep a list of specialists for each area of law and some have lists of low-cost attorneys or ones that give free evaluations. They will point you in the righb direction.

Also check to see if you have a Legal Aid office nearby. I don't know if you would qualify for their services (they have income cutoffs) but someone will spend a few minutes with you and send you to someone who can help.

Also, another good reason to talk to a lawyer is if your employer decided to retaliate for your complaint. If they know you're working with someone, they'll be a lot less likely to fire you, cut hours, etc.

Another wrinkle in this whole thing is the company does provide 5 sick days per year (which they suggest using to make up the unpaid days), but by this late in the year they've all been used.
Think that would make any difference in court?

I say benefit for both.
Illness from the 8th day though, while from the first day if injured.
