yes i think swordfish counts.

There was a movie a long time ago with Vil Kilmer where the 2 main characters died.

I my lil crap stories i write, i always have the bad guy win, because i then to make them really cool badasses, or someone just misunderstood, like me.

"Bad News Bears" and "Dr. Strangelove". "Seven Samurai"... sort of (remember last line). Also "Shane" slumped over on the horse, though like 7S that's dying not losing. Maybe "Crouching Tiger", however she turns good at the end. Definitely "Invasion of the Body Snatchers" (at least the '78 version, can't remember the ending of the '58 flick). Also "To Kill a Mockingbird" and Scope's trail in "Inherit the Wind"

not to be too nitpicky, but are the bad buys 1)the ones you root against, or 2) the ones society deems to be bad (eg criminals)?

from looking at my DVD collection (picking movies off the top of my head seems too hard:

Where Criminals win:
Out of Sight
Ocean's 11
Heat (mentioned by Xecter)
Usual Suspects

Where Heroes Die:
Seven Samurai - its the Farmers who win. The bad guys (the bandits) all die, and the Good guys (the ronin) lose b/c they earned nothing, and some died.
Leon: The Professional

so many more, but i'm too tired to think...

Yes, and don't forget "Silence of the Lambs"
