Depending on what is broken and how much Sennheiser charge for fixing them it may not be a horrible deal. But then again you may end up with a paper weight worth $9,000...
Don't go for it unless you can figure out what is wrong with the setup. The headphone if broken will cost near $3000 to fix alone. Senn has no policy of repairing the HE90's driver elements, so they will just build you a new one. Also, it is a big hassle b/c you will likely have to ship the setup to have Senn tech. evaluate. If you can get it for 6k it will be a fair deal.
this sounds like a very risky investment. would only consider if you can reasonably estimate the cost of repair, which means you need to know what's wrong with it.
My advice would be to walk away, as it'll be quite likely to be a black hole of cash deal. You should definitely be able to get it fixed, but if you're already starting from $9K for a dead unit that seems like an incredibly bad deal.
I bought what I was led to be a 'mint' example (my arse), and I ended up paying basically the new price after the system was reconditioned. And my system was, as non-mint as it may have been, at least in more or less working order.
