Headset recommendation for using between smartphone and laptop

Hello everyone,
 
I recently purchased a Sennheiser HD202II to use in my laptop and I am extremely disappointed with it. I hope it is a problem with mine (which I am totally returning) and not with the model, I like Sennheiser and prefer to not believe they made something that bad. I was trying to listen to Interstellar soundtrack and it became a total mess, my Asus earbuds that came with my Zenfone are WAY better.
 
I was looking for "portable" over the ear headphones for my laptop. Problem is they can be heard if they are not totally flush with your head (and when they are using glasses becomes a problem) and they are a hassle to carry. It was at the moment that I tested my Asus earbuds on the laptop that I noticed how dumb I was being, I always have my earbuds in my pocket, instead of getting a new headphone it makes much more sense to upgrade my headset.
 
I am looking for a headset, I need to be able to answer calls with it. They don't need to be bad ass, they will be driven by an Asus Zenfone Go or a laptop with an on board solution (nothing fancy).
My budged for a headset upgrade would be $40, for a headphone $40, since it will do the work of both budget is $80 max, I would prefer to be a little lower than that.
I really prefer in ears, the other ones hurt me. I am mostly interested in sound quality for movie soundtrack kind of music, they will be used to play games and listen to rock. Truth is I listen to everything, but epic music (movie soundtrack) is definitely what I am looking for (followed by rock). Microphone does not need to be great, just enough.

I like the 1More Triple Driver for you at $86.21 on amazon. It works for apple and android. Outstanding sound quality and worth the extra six bucks above your budget limit. Really good. Check them out and see what you think.

But not only it blows my budget in the best case scenario, they only sell used ones for this price. Used earbuds don't sound good for me (not hygienic).
A new one is a 100 bucks.

Well, now it is not just a matter of upgrading, my Asus headset just started dying.

That is indeed a bummer. One more you might check out is the SoundMAGIC E10C. It has really good sound quality, is ruggedly built, and has a mic.that works with all smartphones. I own one and I recommend it highly. It is about fifty bucks. Don't let its modest price fool you--it sounds terrific. I also like the Beyer Byron a lot. You might check it out and see what you think. It is also around fifty dollars (also has a mic and remote). Some thoughts for you.

Looks good well within the budged!
 
I will see if anyone else has other recommendations, but this one is sweet!

Hi Ronnyls,

This may be suitable for you as well or at least consider headset wise as it fits your price range but isn't an in ear :

Or for actual in ear which fits your budget :
