Been over 2 months and headphones haven't arrived yet. Need help.

I bought a headphone from someone here that lives in Poland on May 13th, 2011 and the item has not arrived to this day. I received a tracking number from the seller, and the item got held up in customs, but tracking said it left the customs facility and was on its way to the US on May 27th, 2011. USPS also received the tracking number so I could use the USPS website to track the headphone. It has not updated since May 27th, and its just stuck on "Your item has been processed through a sort facility in PRUSZCZ GDANSKI, POLAND at 1:08 pm on May 27, 2011." I was in constant contact via PMs here with the seller, but I recently brought up opening up a PayPal dispute in the PM conversation on July 5th, 2011 and he hasn't replied to me since then.
 
I opened up a PayPal dispute and it says that I am not covered and I did not know why. I soon read that I had to open a dispute within 45 days of purchase and unfortunately it's past that already, I never knew there was a 45 day limit. I really wanted to give it a chance because the seller was nice, and I know international shipping could take a bit longer. I hoped that it would arrive sooner or later, but it has gone on way too long. I don't really care for the headphones anymore, I just don't want my money to go to waste. Especially now that I'm broke and barely making payments.
 
It seems that the seller has abandoned me, and PayPal won't be able to help me as well even though I used a standard transaction rather than sending payments as gift, etc.
 
I don't know what to do now. Honestly, I just want my money back now. I've waited so long that I don't even care for the headphones I bought anymore.
 
Can anyone suggest a best course of action to take?
 
Any suggestions is appreciated, thanks.

Overseas shipping can take a looong time.  I waited 2 months for a shipment from the UK to arrive.  Maybe the headphones will still get to you.
 
Thanks for bringing up the 45 day limit on Paypal disputes, I didn't know that.  I've got an issue with a long delay from a seller (non-headphone related) I'm going to have to get moving on.
 
Edit:  Btw, did you use a credit card to pay the Paypal transaction?

Sometimes stuff gets majorly held up,  and I sort of feel like might be what's happening and the other person just didn't know what to tell you. You can try contacting whatever shipper supposedly has it and go from there.
 
If it turns out you need to get it reversed:
Call paypal up, escalate the situation until you get to the highest authority you can get on the phone, and proceed to throw a fit.  Their rules aren't set in stone and you did go about things legitimately.

Thanks, I hope my item will still arrive. The Paypal's 45 day limit is way too short for international transactions because shipping takes so long. I used a Chase debit card for the transaction.

I honestly have no clue who has it right now, it's supposed to be transitioning from Poland's postal service to USPS, so it's probably stuck somewhere in the middle of the sea lol. I guess I'll try USPS first, and if they can't do anything, I'll wait a bit then contact Paypal and throw a fit even though I'd hate to do it. Thanks.

I work for the post office in Canada, and can tell you that international shipping, especially surface shipping (the cheap option) can take 3 months or more.  With surface shipping, the item is loaded in a shipping crate and that crate is held until full.  Then it is loaded on a boat, and is taken across the ocean.  Then it sits in the docks waiting to be picked up and so on.  Surface, if that is indeed how it was shipped, will take a while.

Yeah I think the seller told me it was the cheapest shipping option which is traveling by ship. Wow, 3 months or more is insane. This is going to suck.

I know its no consolation. Since you have a tracking number, I wonder if there is a way for you to contact the Polish mail through email and inquire about the status of the parcel? Its a long shot.

Thanks. Those sites just show me the same tracking info I have from the USPS website and the Poczta Polska. I would contact the Poland postal service if they could understand English, and if I knew how to contact them lol. The seller finally replied yesterday and said he'd try to get the problem resolved. So he might be able to contact Poland's postal service.
