I'm really looking into buying an ATH-E40, looking at it the price looks good, reviews about the sound has been really surprising, but the only thing really that gives me second thought is the fit in your ears. Many says it won't fit well, or it would drop out easily. Should I go for it? A few other earphones I had looking at was the ATH-IM50 or the M6 Pro (MeeAudio).

Just got the E40 and I really love the sound. I think it's superior in sound to the IM50. IMHO And way above the M6 Pro. It seems closer to the CKR9 LTD, which I had a brief experience with.
In terms of fit, it's miles ahead from the CKR9 for me, only because the over the ear fit. Somewhat similar to the IM50, but slightly less bulky. M6 Pro was slighly better in terms of fit, but not in the same league for the rest.
I am still testing the E40, and yes, the fit is not the best. With the JVC Spiral Dots, it seems to improve sound for sure. Not much impact on the fit except the Spiral Dots are smoother than stock tips, so...
