Thanks for the advice, I think I will do this as the seller is not responding to my emails. It's a shame really.

What will eBay do about this?

Well if you paid thru paypal, the ebay dispute page will route you thru paypal and using the paypal transaction id, a dispute is opened against yhe seller. The seller will have ample time to resolve with you mutually and until that time the equivalent money is locked and wil not be released to transfer to his bank account. So he has to either refund in full or send a new replacement to you which again mutually agreed by both parties. So you get what you need.

Thanks, seller got back to me and is promising that they are new. I wonder if I should just keep them and ask for a partial refund? He has acknowledged that they are 'opened for testing before shipping'

To me open box means a used item.

True. Open box means simply used,as it might be customer returned or refurbished. If the seller knew its an open item this should've been mentioned in the listing as open box item.

And well yeah, If you are satisfied with the condition of received item you can assess its worth and ask for appropriate cost to refund(difference) and See what the seller says for your offer and close the deal if you are ok with it.

You are officially the first here to have access to both versions, so I am looking forward to your impressions. :)

I have already posted impressions earlier in this thread, what would be great is some input from other MK2 owners as to whether the sound I am describing is similar to what they hear.

I am returning my MK2 for a refund (due to box not being sealed and they look used) and will probably sell the Classics too. Overall I think the Hifiman RE-400 has the sound sig I prefer and is a keeper!

Ah, I thought you said you were going to exchange your current pair for an unopenend pair. I thought the new pair would sound different, so your impressions would perhaps change as well. :)

Ah, yes... well the seller doesn't have any sealed ones so just going to get a refund for now. Not sure many places have them new any more!

Just wasn't meant to be I guess. I will stick with my re-400 which I am very satisfied with. I think of it as my baby HD600 but with smaller soundstage and less veil on the mids : )

I am so confused with so many versions of the mk2 now... I just bought an mk2 through a third party seller from china that was listed on the amazon product page for the older non-classic version of the mk2 for 163. However, seeing as everywhere else they are unavailable, I am unsure whether they are the classic version or not. 163 makes it seem like it would be the older version, due to similar price, but on fleabay, I saw a seller selling the new "colored versions", which I am guessing are the classic 2014 edition, for 179. Is it definite that the newer 2014 editions do not come with the hybrid tips? Maybe I can base off of that when I receive my mk2's in a few weeks...

Just to clarify, I DO NOT want the newer 2014 classic edition, and DO WANT the older mk2's.

I looked a week or so ago. I saw there were many colored versions of these headphones still claiming that they have biocellulose drivers. At this time I would probably try and online buy from reputable sellers.

Yes, the new 2014 Classic Color Edition do not come with as many tips as the previous releases. Only half of the amount. The new ones are $119, compared to the previous $179. Drivers are apparently NOT bio-cellulose but worry not, the CCE sound amazing in their own right. I am enjoying the hell out of 'em and they beat all my other IEMs in the SQ department. Will update my first post soon. :)

EDIT: OK NOW I REALLY AM CONFUSED! Lendmeurears, normally a very trustworthy and respected seller, actually says these DO have the bio-cellulose drivers... check it out: http://www.lendmeurears.com/product_info.php?currency=USD&cPath=15&products_id=89
