Just like how companies use legal loopholes. We are as well.
The mass majority of anime we download on AT or and to a slightly lesser degree of older ones are not lisenced in the USA. OR, companies that once lisenced them (ADV or Funimation or Toei etc) either went bankrupt OR never renewed their lisences. Stimulcasts that Crunchyroll are doing now are in a very big gray area.
Did a bit of digging around myself, albeit only 5 minutes. Still can't see it as a 'big gray area'. The first licenses that they acquired are from TV Tokyo, Shueisha and Pierrot back in 2008. I don't think they'll stop doing that - getting licenses - since then.
