Aussie law? There are a few US lawyers here; we might be able to help in a very general way. Australia's system is similar, but I know that real property is handled quite differently down there.

I'm going to post a shortened version of the question here. My job is to report to the band and film maker on any legal/copyright issues that could arise from this.

 

 - Independent film maker wants to make film clip for independent band.

 - Song was written by band, in singer's home studio.

 - Some old backstage footage taken by the drummer is going to be cut into the clip.

 - Band has some basic ideas for video.

 - Music video to be placed on youtube, band's website and an extra as part of the CD package, distributed by a record label.
