  The idea that you're always fully protected with Paypal is just wrong. The buyer is not guaranteed his money back. If the seller doesn't have the funds in his paypal account to put a hold on, they're gone if he closes it and he's had plenty of time to do so. That somebody would go to all this trouble of closing accounts over $100 would amaze me so you're probably fine but this isn't coming out of Paypals pocket unless it was a protected sale and even then it's under very specific conditions. For instance, if you send money as a gift, you have no recourse. Even if an item gets lost, as far as Paypal is concerned, product wasn't involved. Don't do it! I just find it odd that he bothered to ship you something if he was going to close accounts anyway. Probably just a dope. Perhaps that will work in your favor at some point.

 

There's no way to make a gift payment when purchasing something on Ebay.  When you purchase something on Ebay using Paypal you are protected by Paypal against 1) non-delivery and 2) quality / condition of product. Once you file a Paypal case, and the seller does not respond you WILL get your money back.  Whether the seller has enough funds in his account or not to cover the "hold" amount has no bearing on this.  (If he does not...he will simply have a negative balance with Paypal that will eventually be handed over to a collections agency if he does not make payments, it will eventually affect his credit, so unless he's trying to fake his death and start life a new for these TF10s, there's no getting away from Paypal.)

 

By the way, interesting tidbit: you are not protected for quality of your purchases on Head-fi.  You are only protected against non-delivery.  So if someone sells you a $500 amp that has some serious problems, Paypal will not help you so long as the package was delivered. =]

I have used the Ebay Resolution centre a few times now and each time have had a refund. My cases have included goods not being delivered or not a described. It takes a couple of weeks but I am sure you will get your money back.

Just want to add, if he has only had an account since February, Pay Pal automatically puts holds on all payments until either (think) 30 days or until positive feedback received. He may have cancelled his ebay account but I would expect your money is still within Pay Pal which will make the claim easier for you.

I wasn't referring to Ebay about gift payments. I see it in the classifieds here all the time and it had a hand in some easy thievery a couple months back. You technically can still pay via gift for anything on ebay if agreed upon, you just can't use the checkout facility to do so though that would obviously be foolish.

They don't do this for every auction. I couldn't call up this auction to see so I don't know about this one. If they didn't, they will not go to collections. They only do so when they're out the money and not on a members behalf. It's not their money to collect. In that instance it's on the buyer to involve authorities Credit card companies etc. Even if paid via CC, it's hit and miss. If you think every ebay mishap has had the money returned to the buyer, you just haven't been paying attention. It's particularly troublesome across borders as rights and laws vary by coutry. Fortunately, the vast majority of cases get sorted but not all.

 

Marty, That's good info on account hold for new members but we don't know how long he's had a Paypal account, do we?

Paypal, in my experience, guarantees every transaction for buyers on Ebay.  Paypal will refund even if the funds aren't there.  Here's an example: Sold about $.8K worth of merchandise on Ebay.  A few weeks later (when my balance was $0 and the buyer filed a claim) I suddenly had a negative $.8K balance on hold.  I chose to refund the buyer and pay back the balance, had I not responded or lost the dispute the buyer would have received the funds and I would have been sitting there with a negative $.8K balance.  I've had that happen before as well.  

 

Another interesting thing: if you buy something on Ebay and find you didn't properly read the listing for an item - for example if you buy a laptop without a power adapter and want a refund, you shouldn't file a claim with Paypal citing the lack of a power adapter as the reason, you will lose the case.  You can make any bogus subjective claim, like "I'm not satisfied with the condition of the laptop" - you can be as ambiguous as you like, and you will win.

 

So yes, you don't win every case as the buyer, not without some tact at least.

I've got 300 feedback at 100% pos on Ebay with many thousand$ through my account. I just read that they have changed their coverage about a month ago to be more encompassing so you may now be closer to right than I am but I assure you it wasn't that easy before Jan 28. I have always limited my sales to the US and been VERY careful about foreign purchases to help avoid problems. I'm finding that Ebay gets more problematic every year and is probably why Ebay has recently changed it's protection, to keep it's audience. Just had a buyer never contact and the last 2 things I bought weren't quite up to snuff.

Hopefully everything works out and you get your money back. I feel your pain though, I've had my fair share of bad fakes and bad dealers. I don't really have much to contribute as everybody already gave solid advice. Best of luck to ya.
