Some Legal Help Please

Hey guys I need your help regarding a car accident I had, thankfully no one was hurt and the damage was minimal.  We decided to settle the matter without the intervention of insurance because it was my fault, and I didn't want to increase my girlfriend's premium.

 

Well the accident basically happened last years months ago and we exchanged information through the help of a police officer.  Well anyways until this date the person has yet taken their truck in to be estimate the damage.  Is there anything I can do to make him go and get his truck looked at and to get an estimate?  The looming cost and wait is causing a weird tension.

 

I made contact with him and gave him the repair shop's information on November 5th, and he has yet gone to the shop.  I've contacted him a couple of times since relaying he information for the shop.  But till this date he has yet gone to the repair shop.  Is there anything I can do?

 

The accident itself was a low speed collision where we rolled down hill about 3 ft into a truck's front end.  We want him to go to the repair shop as soon as possible because it's the rainy season here in Hawaii and I don't want to pay for anymore damage.  Sadly we didn't document the damage with a camera.

 

I'm afraid of getting scammed because when we called the police he kept on bringing up the price in how much the repair should cost.

 

So is there anyway I can get him to go to the repair shop, and is there some sort of statue of limitations on having to pay the fee?  Because in my opinion we've tried on multiple attempts to get the damage looked at and repaired but he is the one taking his sweet time.

I am not an expert in legal matters and can't comment on your specific situation. IF the other party gets into another accident they may try to blame you. Did you protect yourself? Is the police report accurate describing the damage to the other vehicle? Do you have pictures of the damage?

It was my first accident so I didnt' take anypictures, but I didi look at the damge and have a quick look over.

Make sure to get a copy of any police report so you have documentation of any damage observed by the officer...and the police may have taken pictures you find out about that as well.

Was there an actual police report or did a cop just help you in getting each others info?

I don't think there's any way to compel someone to get an estimate. You could contact your insurer and they will contact his insurer. Then the insurance companies would work it out and you wouldn't have to worry.

If he waits too long, the claim will be barred by the statute of limitations and you won't be liable. The time would depend on the statute of limitations in Hawaii.

Since you exchanged information it might be wise to swing by and take some pictures of the damaged truck, that is if there is no additional damage.

Just lodge a claim and be done with. Maybe your girlfriend will get a bigger prem, maybe she won't. Maybe she might get a bigger xs? Who knows. 

 

It does seem clear the TP doesn't give a hoot.

Hmmmm.... first, I think I'd found out if there was an actual police report, and then find out what the statute of limitations is in Hawaii.

 

In college once, I got into a minor fender-bender with a guy in a parking lot. He was on his way to a class and didn't want to call the police, so we just exchanged info. He then started calling me and telling me about how the frame was damaged or some such nonsense. I knew that there was NO way that had happened because of the accident I was in involved in (and it was already debatable who was at fault.) Since there was really no way to prove that I had even BEEN in an accident with this guy, I just told him it wasn't my problem and to stop harrassing me. I felt bad, but I wasn't going to get stuck paying for damage I didn't cause.
