Hey, I'd love to test the first sale doctrine as it applies to digital music downloads.  But I too prefer to have physical copies I can hold on to - whether it means playing an LP on my turntable or having a CD that I can use anywhere - including letting a friend borrow it.  I still prefer real books, real paper, real printed photos, and real anything...  Much better than a bunch of ones and zeroes.


It's interesting that you're even familiar with a US court case about first sale given that you're in the EU.  First sale in the US and whatever it is that is the similar concept in the EU is different.  The enforceability and what can be in a EULA is different.  Whole different sets of laws.  I try to follow what goes on in the US since I live there.  I follow very little of what goes on about that in the EU.  I don't know EU law or rights.

 

I too prefer buying a physical copy of music.  I will continue to do so as long as possible for as long as physical copies are available.

 

A big concern I have about the inability to resell digital downloads is that it will mean the end of the used market for music.  The used market is the only place where some music is available.  Try buying an old mastering of a classic rock album.   You can't buy it new.  You can only get it used.  If you buy it new you will get a new re-mastering.  If you buy a digital download of that album you'll get a new re-mastering.  The used market is the only place where the old masterings are available.  The used market is also the only place where some classic recordings from decades ago are available.  They're only available now because collectors have archived them.

 

We're already losing digital recordings due to neglect by the labels and owners.  That trend will only get worse if collectors are unable to acquire and collect recordings that are only available for digital download.  We need a healthy used market to be able to keep the old music around and available.
