It's too bad that I don't like those "stepped attenuator." As each click is applied up or down on the volume level, static is applied and heard through the headphones. This is noted "characteristic" on their products, though.
My Lake People G109 has a "stepped attenuator" (if I'm understanding that phrase correctly. Its not a smooth volume pot but instead has "notches" as you move it up and down) and I experience the same thing (static/noise while changing the volume) but this isn't something unique to my G109 or to "stepped attenuators". Volume pots of all shapes/sizes/qualities get dust in them and produce static while working the knob. I've experienced this on virtually every piece of audio equipment I've ever used, for example my friend's 32-track Mackie mixing console and every volume pot I currently have in my setup. They all produce the same static noise, to varying degrees. There are tricks for loosening the dust inside the volume pot and reducing or eliminating the static noise but it will always come back. Its a non-issue IMO because there is no static or loss of sound quality when the volume pot is stationary.
I can understand your position, and your points regarding the Lake People amp, too. Plus, if one uses their level control in the software application (e.g. - Foobar) then the stepped attenuator may never have to really be moved unless you switch between some efficient and not so efficient headphones. However, my main "rub" with it is that I've going to drop that kind of coin ($800 or so) on an amp, I would be a bit frustrated. It's too bad an option for a different volume pot isn't available.
Anywho, back to getting on topic. From all of the posts of recent, it seems that many retailers are getting around the Sennheiser-enforced MSRP-like selling price points. I think this is welcoming and those e-tailers with the most creativity in doing it, especially on the higher end models - $400 and up, I think they'll win some pretty good business.
