 Hate to break it to you guys but clones they are not. The brainwavs is crap compared to the original fischer's. Just my opinion.

Whether they are exact clones, built in the same factory, is not an opinion. You're the first person I've heard say that they are not. Care to elaborate?

Agreed. I've heard that there are differences between the pads between some of the clones which can cause minor variations in sound, but there seems a clear consensus on the Brainwavz HM5 and Fischer Audio FA-003 threads that these are the same phones. 

Yea thats what I've read as well. The fischers come with velour pads and I think an extra cable, but other than that people who own both say they have the same sound sig.

Can you check if they'll ship that to the US? For the things they will ship, it's usually a straight Euro to dollar conversion after they take out the VAT and add international shipping. That would be $180, which is a lot less than the US pricing.
