If we discovered something akin to a dolphin or pig on another planet, I think we'd do everything humanly possible to probe their sentience. If dolphins are capable of empathizing with other species (and, say, rescuing said species from sharks), then there's certainly room for intentional killing not related to hunger. But "murder" in the legal sense is quite silly. If an animal isn't capable of understanding a trial, I'm not sure a trial would be particularly fair or meaningful. At best these "killer" whales are guilty of manslaughter. Imprisoning a creature whose habitat is countless miles of open sea bears some similarities to the Austrian who kept his daughter and half of their children locked up and without sunlight for 24 years.

we're missing the picture here. The whale was kidnapped out of his natural environment and forced to be something he's not. Man committed the first crime. How could the whale be committing manslaughter by merely treating his trainer like he would a seal he just picked off a beach? Ridiculous....
People are not animals and animals are not people. Sure we're both carbon-based-bodied but a supercomputer is not a toy walkie-talkie just because they have similar parts and materials....come on

To some degree I feel they can commit murder.. They communicate different from us.. We don't know what they are saying to eachother, but I feel it goes deeper then that.. Monkeys, etc are intelligent.. I read some stories that would make you think twice about animals conspiring, or about pre determined attacks or 'murder.' It is interesting. These are all wild animals to be begin with.. Animals that some people try to domestic but can't.. Like chimps.. In general, animals know right from wrong, & just like people each animal should be looked upon as a individual, stead of a group.. I owned many dogs & some cats, they each had different personalities that made them unique. In the end, no wild animal is trust worthy, & I think caging animals so people can gock at them at Zoo's just adds to the animals frustration & bitterness.. Like those fools in SF who egged on a Tiger.. Just like a person, the tiger didn't like it & attacked them.. Of course they blame the tiger for being 'vicious.' Well, yeah, that are predators & see humans & other animals as food..

No, they cannot.

Murder is a human construction, and is defined only as thus.

Animals can kill, and they have every right to.
