Need input on problem with seller

I recently purchased a pair of Westone UM2's from the Gear for sale section of this site. The seller is in England. The payment was made through Paypal and the item was promptly shipped to me here in the US. It however arrived damaged. It was not properly packed and the case was missing. Fortunately Westone repaired them at no cost and the return shipping was free. I'm still out the cost of the insured shipping to Westone. I've contacted the seller several times requesting reimbursement and there has been no response. Is it fair to ask him to do this? I think so. I feel he is not taking responsibility for his actions. I'm not exactly rich and saved for these for a long time. What do you think?

I think it's fair to ask him to, and would be the right thing for him to do in this circumstance.

Of course you have no consumer rights buying from classified so have to accept he can just ignore you.

Link him to this thread when you ask him one more time nicely, then give him both barrels in the feedback section if he still ignores.

Sellers have a responsibility to package the items they sell so they arrive with the buying in the advertised condition.

I would expect for the seller to pick up the cost of taking care of the damage, which should include shipping. At least Westone took care of you. That's pretty cool.

I would definitely leave feedback.

I also agree the seller needs to reimburse you for the damage as described (Note: I am assuming your statement is correct). I would also leave feedback on the seller.

I think asking him for the cost of insured shipping to westone is fair providing you provide proof.

Alternatively, a refund on the original shipping costs would be fair.

Ultimately thats all your out (barring the inconvenience...but **** happens) so anything more than that would be unreasonable.

If he hasnt replied for a week and previous communication was ok, then id just be fair, reasonable, truthful and objective about your feedback.

Maybe the last pm to the seller could remind them about the feedback thread which may get them to respond to you?

Have you checked your remedies with PayPal and/or your credit card issuer yet? You might be able to get the shipping refunded through them.

Depends how bad it was packaged really. A pair of IEMs really doesnt need much.
Was it just thrown into a bubble envelope, or was it in a decent box that the deliverer smashed?
If it was lightly packaged, then maybe the seller owes some money, but if it was in a reasonable box, then maybe the deliverer should be contacted.

Thanks for the replies. They were just put into a flimsy plastic case and sent in a bubble wrap envelope. If they had been put into either the original case or a hard box, this would not have happened. And yes I will forward the link to this thread to him by email.

Flimsy plastic case. Was it a hard/rigid plastic case?

No it was a soft flexible two part case. Anyway the seller did finally respond and issued a refund.
