i just can't believe it...

i've been such a fool to go through with a group buy for the PRII LE.

Larry won't respond, and the partner is getting out of the whole
deal...

i would like to take some legal actions and wanted to know if somepeople
can give me some advice... if i can sort it out, i don't mind flying over there..
(can't i charge my flight fees too? if it becomes some legal actions?)

in a short, this is what happened

1)Larocco announces PRII LE
2)I went for a groupbuy with people i know in Japan.
3)got the tracking number that you get when you
request shipping online. (have used this service before
and people ahve been quite honest about it in the past)
4)paid 3000$ including shipping and all
5)the item couldn't be tracked.
6)found it odd, and contacted the manager and larry.
7)manager was responsive, larry was not.
8)after searching for the parcel in japan and us,
it came to a conclusion that the parcel was never shipped.
(3monthes!!!!!)
9)manager promises a refund. (larry still at dark)
10)manager sent 120 dollars for first initial refund(still in mail?!?!)
11)Manager backs out. and won't pay anymore.

and this is where i'm at...

i read few replies from the other thread...
what do you guys think?

I hope you have documentation of these events somehow. If there is proof that you had an agreement and that agreement was breached then I believe you have some leverage. But I'm unsure as to how well electronic documentation holds up in court.

all the emails that went and came, went through my
hotmail account so all the dates and time are stamped on the emails.
so i think i'm good for now.

We have a saying here in the U.S... "you can't get blood from a turnip".

You will spend a lot of time and money to pursue this claim, and maybe even win a summary judgement against Larocco. However, there will be no assets to collect so you will have a moral victory. If that makes you happy, then go for it.

As for taking legal action, it would be a lot of time and more money for no return.

Unfortunately there is little you can do,

Laroco not shipping product on time! Who would have guessed?

people on these boards know my bias towards mikhail & singlepower. Im willing to wait for something to be built for me, simple as that.

You got the run-around for a product that is (relatively speaking) a mass-produced item.

Why would he be unable to get anything out of legal action, i.e., "squeezing water out of a turnip," "a lot of money for no return"?

Because the entity that he would be taking legal action against will have no assets.

I bet everybody in their lifetime wishes the same thing for their name at least once.

No, it's pretty much only Larrys that experience that.

(1) Why would it have no assets? (2) Do all legal entities insulate their owners from personal liability?
