Is it against eBay/PayPal TOS for an eBay seller to ask buyer to pay PayPal fee?

I won an auction and the buyer lists the following under payment instructions:

Paypal adds 3%.

I saw this before I bid and 3% amounts to 43.5 cents. I almost don't care, but I thought eBay sellers couldn't pass the PayPal fee onto buyers (without including it in the item's price). I'm curious more than anything else.

You are correct. It is against eBay TOS for a seller to charge an additional fee for Paypal payments. http://pages.ebay.com/help/policies/...urcharges.html

Yes.

You'll probably still want to purchase the item (you've already won), in future you should notify eBay. (unless you really, really want it, would fight to the death to own it, sell your soul to touch it, etc.)

I'm going to go with selling my soul on this one.

Actually I just paid the seller for the item + shipping with a little note that his request for the fee violated eBay's TOS. I'm banking that 44 cents is not worth his time and that he won't risk a complication over it. It's eBay though, so we'll see.

Edit: of course, I just risked a complication over it.

why would you tweak him about the TOS after he has your cash but before you have your item? that's just inviting something bad to happen. if anything, wait until you get your item, THEN diss him or do whatever you like. right now he has all the power and you just have Righteousness.

I personally don't really care that he asked for the 3% and would never leave negative feedback or anything of the sort. I don't feel like being retributive about it, and I was cordial in my note to him. However, according to the TOS he shouldn't be asking for it, so I don't think I should pay it. I'm not a seller on eBay; any conflict or dispute will affect him more than me. I think he'll realize that and, again, I'm banking on his not being willing to risk conflict over 44 cents. I could have just paid the 44 cents, but it's the principle of the thing, man!

Sometimes I like a little bit of risk. This feels like playing rummy.

Yeah I should have just paid the stupid 44 cents. I'll never get into the magic kingdom now, and I jeopardized my getting a tube. I was so dreary-brained at work though, so I shouldn't blame myself chicken fork book spoon.

I doubt the guy will risk getting his e-bay account suspended over a little message. He should be aware that is violated the TOS though. If the item was really expensive then it would be a different story.

If I was in the mood, I'd send ebay a note of the transaction to tell them of the violation. Should set the seller straight. Ebay takes a few days to respond but they usually resolve the matter.

yeah thats a no brainer really isnt it, amazed that some sellers are stating to charge it separately when its against TOS
