Scammed by kjs8806, future buyers beware!!!

Hi guys heres the story. i have just gotten in this hobby, and before i seriously commit my self, i just want to try some stuff out. as a college student, i dont have a lot of cash after loans and living expenses, so i decided to get an AKG K81DJ for my starter headphones.

i saw a decent deal (at least i thought so at the time) for $56 shipped, after checking out the seller's feedback, i decided to take it even though his feedback was somewhat spotty (dug deeper and found some inconsistencies). I paid on the 12th of Jan, he told me the payment was cleared on the 13th.

i told him to hold onto it for a bit until i can clear shippment with my school during break, he agreed and last wensday, i told him it would be alright to ship it. however, the he told me the payment have suddenly been put on hold by paypal, which is very weird considering it was cleared the next day and it was not e-check, he did not ship it.

i asked him to refund and after two days of non-response, i filed a claim with paypal. that very same day he said he can refund, but can only do so if i retract the claim, there is no way i am going to retract a claim when i cant file it again if he doesnt refund me. now i am minus $56 AND a AKG K81DJ.

You were a bit quick to file a complaint with Paypal. Since the incident, have you asked him why he didn't reply to your emails? Something does seem a bit fishy, but I don't think people would scam for a mere 56 bucks. Keep us updated and best of luck with it.

So he's telling you payment is on hold, yet in reality it has gone through? Sounds bogus to me... if its sent then its sent.

Double check paypal rules. Is it true that a seller can not refund payment if theres a complaint filed against him?

If thats the case, ask him to mail you a check... then you can retract your claim once it passes.

I can't think of any other way.

Seller stated that the payment was cleared on the 13th (next day after payment).. If he hasn't shipped the item yet, he just needs to provide proof to paypal that it is shipped (needs to ship with tracking/confirmation) and they will take the claim off.
It seems like the guy has 3 transactions here which all went through..

exactly, he can refund me, yet the payment didnt go through....yes i have heard from a few other members that indeed paypal freezes the funds, and i have asked him to send a money order/check, but he has not replied. i have not posted in the feedback thread until everything is settled for sure.

i know he havent shipped because he told me so by PM, i will post the screenshots when i get them in acceptable resolution. He has 3 posts in his feedback, one of which is from himself, the other one seems spotty in which if you look through the deal, he accepted offer from one guy, but sold to another because the second guy offered a higher amount, despite the fact that he has accepted the payment from one guy already.

In that case, keep the dispute open and he has to respond within a certain time range (2-3 weeks) by either refunding you or shipping the item.

Well, my only advice is get a cashier check or money order, don't accept personal check.

Make sure that you do the feedback posting properly for future record.

It sucks to see these problems.

I had a similar situation. It was just $20 for a ALO dock, and I still don't have my money back. I knew that he, the seller and member of Head-Fi, is just a student, and I did not want to ruin the his reputation just because of $20, and ignored my loss. I hope that he read this thread.

I also hope that other fellows should learn that reputation and track record is way more important in life than just a few dollars. If you have enough intelligence to be a scammer, you should have more than enough potential to be a great person in life... Be good to yourself.

You should only buy from sellers that have at lesat 5 selling feedbacks that equal the worth of $500 or more.

That's how I see it.

Nice to know you came out OK, kudos to you for sticking it to him. Theres FAR to many scammers around here lately.

All you have to do is contact your credit card company and inform them of a failure to deliver.

Then the credit card company can hound him and make his life miserable and you get all your money back instantly.

Wouldn't that make it impossible for anyone to accumulate any feedback at all? Everybody's gotta start somewhere.
