Got screwed over--Iriver on eBay

I won a H140 on eBay last night for $175.00. I was so excited I could have optical out from a player now that I have the MicroDAC. I got this email tonight:

Today we were planning to ship your order and found that there is no unit left. We removed all the listings from ebay except couples that we cannot take out due to ebay regulation. Anyway, this item was a direct shipment from Iriver Koea, because Iriver America has not benn selling this item any more, and Iriver Korea will not supply this item to us for some period of time. So we will have to refund your payment upon receipt of your confirmation. We are so sorry again for the inconvenience that this may have caused and would appreciate your understanding and patience in this matter.

I am so pi$$ed! This doesn't make sense to me. Apparently they had all the listings for the H140 on eBay because there are none left now. They had many more listings after mine. If they only had one fewer than they needed, what about the other listings? Can I do anything about this? What if the guy was unhappy about the auction price?

I don't think there is much that can be done...at least they are giving the funds back promptly, you did get the money back right? (I hope)

I have had several sellers pull auctions after I won them, one was even so brazen to say that he felt he should of got more money for the item (I forget what it was) but he didn't have a reserver...sorry...and others I had a go around trying to get my money back.

I used to do allot of shopping on ebay, since around 1999, seems last 2 years it's been a steady crap shoot if you will get what you bid on and if it will arrive in said condition.

In any case you can contact Safeharbor and see if this goes against eBay policy....

Thanks...do you know where else I can get a 140? I just need the optical in and I know I can get a 120 but I really need 40 gigs. I can't seem to find one anywhere. [EDIT]--found it at www.misticaudio.net . It says they still have a few left.

That seller on eBay left me feedback when I paid. I'm going to neg him. I had to pay $100 more at misticaudio.

At this point I would forget about trying to get the player and just try and get your $$ back. I hope you used CC through paypal.

On the misticriver Hxxx forum, the reps of various Hxxx sellers on eBay are discussed in detail. Your seller, outletmp3, has the best customer service and quality control record listed on that board.

Outletmp3 has a valid reason for not sending your H140: he simply ran out of stock. That has happened to me before with other vendors and I've never given them negative feedback. It is the least of what can go wrong with an eBay purchase.

My two transactions with outletmp3 went flawlessly. However, a friend of mine bought an H140 from the same seller and the hard drive stopped working within a day. My friend's H140 was exchanged without any problem.

I own two H140s from that seller and both work extremely well. Additionally, outletmp3 included an US adapter, a remote and many other pieces which emilyandlily, the other major source of the H140 on ebay, reportedly does not. I've also read of many bad experiences with emilyandlily. Apparently, they don't pack their accessories safely; transit damage can result.

Your winning bid was not "too low" for outletmp3. If you visit the forums I mentioned above, you'll learn many people have bought their H140s from him for around that price (including me).

Also: outletmp3 might be out of the H140, but I found several H120s for sale at his ebay store. I also found various H140s for sale on eBay generally, but I can't vouch for any of the current sellers.

Before winning my H140s on eBay, I nearly bought one from misticaudio, which is run by a foont named Jeff. In my limited experience, Jeff is a gentleman to deal with. His feedback and reputation with others seem to back that impression. (I might be wrong about this, but if I lobethump correctly, his iRivers have a limited factory warranty.) I wouldn't hesitate to buy from him, though his H140Ds seem expensive.

One last thing: Misticaudio's H140s don't ship with remotes or cases (iSkin offered a rather good bundle for the H140 last week: skin + two clips + five screen protectors + second plastic zippered case: $9.99) and you might have to buy an AC adapter from Radio Shack (the misticriver forum will have details on what to buy and what to avoid). If I were thinking of purchasing from him, I'd ask Jeff whether he included the US AC cable.

That's NOT getting screwed over. It's just an unfortunate coincidence. If you went to a restaurant, ordered a salad, and a few minutes later were told that they ran out of salad, would you consider that as getting screwed over?

Thanks for the replies. I was angry last night because I thought I wouldn't be able to find a H140. I did find one, albeit at a significantly higher price.

Thanks for the tip. I'll find out if he included one or not. Fortunately the remote isn't important to me as it won't really be used portably; just to sit on top of the microstack.

That's what I was looking for last night and couldn't find any in this country. The only ones I see are in Sydney. Maybe I missed them???

I think feedback hostage is what makes ebay stupid, because it reflects nothing about the transaction. I've never given a negative before; however I have left a positive but then explained what happened in the comments. Ebay is stupid because people are so fearful of feedback hostage that they don't leave accurate feedback, leaving the next buyer clueless.

I don't know about that analogy- it sounded like the OP won the device via an auction and as such the seller had ample opportunity over the course of the auction to check his/her supply. At any point in time over the auction they could have pulled the item and let their bidders know. At the restaurant I know almost within minutes that there is no salad - please order something else- also if at the restaurant I am upset (as I was really looking forward to salad) they would probably offer me an appetizer for free for my inconvenience.

I agree with you completely. I don't understand why the auction was up for 7 days and suddenly there was no stock after I had one it and paid. Like I said, there were more auctions that would have been completed after mine ended. I think they probably picked the highest winning bidders and sent them the product.

I must side with the OP. Technically, the seller is in breach of the contract. The contract has been created by virtue of winning the auction according to the rules of the auction house. Legally the buyer is entitled to the difference between the cover price and the original contract price plus whatever the value is of the missing accesories, if any within the new package. Of course, you'll never see that unless you sue. But who is going to pay 10 times the amount of the entitled damages for the legal fees? The seller should do something more than simply apologise.

I've bought things from him as well, and the transactions went flawlessly.
